Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, delivery services, equipment rental, and dispatch programs offered by Exigo Fuels (hereafter "Exigo Fuels," "we," "us," or "our"), a Florida limited liability company based in Hialeah, Florida, serving commercial customers across Miami-Dade, Broward, and Palm Beach counties. By placing an order, signing a delivery agreement, renting equipment, or otherwise engaging our services, you agree to be bound by these Terms.
Acceptance of Terms
By accessing or using the Exigo Fuels website (www.exigofuels.com) and any of our services, you represent that you are at least eighteen years old and have the authority to bind the business entity on whose behalf you are acting. If you do not agree to these Terms, you must not use our services. We reserve the right to refuse service to any customer, at any time, at our sole discretion.
Services Offered
Exigo Fuels provides on-site fuel delivery, generator refueling, bulk fuel distribution, marine fueling, fleet fueling, emergency fuel dispatch for contracted customers, fuel polishing, and commercial fuel equipment rental. All services are offered across Southeast Florida and are subject to driver availability, delivery schedules, fuel supply, weather conditions, and applicable federal, state, and local regulations.
Customer Onboarding and Credit Review
New commercial customers are typically onboarded under a written delivery agreement that specifies fuel types, estimated volumes, billing terms, and emergency-dispatch eligibility. Credit review is required for net-terms billing; new accounts may initially require prepayment, credit card on file, or cash on delivery until a credit relationship is established. Business documentation (EIN, W-9, resale certificate where applicable) must be provided before invoicing begins.
Ordering and Delivery
Orders may be placed by phone, email, or through our contact forms on the website. Orders are not confirmed until Exigo Fuels issues a written or verbal confirmation with a scheduled delivery window. Delivery time windows are estimates based on routing, traffic, weather, and dispatch queue; we make reasonable efforts to meet the estimate but do not guarantee a specific delivery time. Exigo Fuels reserves the right to refuse, delay, or cancel any order at our discretion, including for safety concerns, site access problems, regulatory restrictions, or customer credit issues.
Emergency Dispatch Policy
Emergency 24/7 dispatch with 1-hour, 2-hour, and 4-hour response tiers is available exclusively to customers with an active, signed delivery or equipment rental contract. Walk-in and first-time customers are not eligible for emergency dispatch and will be offered the next available scheduled delivery window. Emergency response times are measured from dispatch confirmation, not from the initial call, and may be extended during declared emergencies (hurricane, flood, prolonged grid outage) when driver safety or regulatory restrictions require longer response windows. Pricing, Quotes, and Payment
Fuel pricing is subject to market fluctuation and changes without prior notice. Written quotes are valid for the time period stated on the quote (typically 48 hours for spot pricing; longer for contracted supply). Unless otherwise agreed in writing, payment is due upon delivery or invoice presentation. Credit accounts are standard Net-30 unless specified. Invoices not paid within the agreed credit term are subject to late fees of 1.5% per month (18% annualized) plus collection costs, as permitted under Florida law. Customers disputing an invoice must do so in writing within ten business days of receipt.
Fuel Quality and Specifications
Exigo Fuels delivers fuel meeting published industry specifications, including ASTM D975 for diesel fuel, ASTM D4814 for gasoline, ASTM D396 for heating oil, and ASTM D1655 for aviation fuel (where applicable). Marine fuel is available in REC-90 ethanol-free gasoline and Premium Marine Diesel meeting ISO 8217 where specified. Bill-of-lading documentation, product specification sheets, and fuel quality certificates are available on written request. Exigo Fuels is not responsible for contamination introduced by customer-owned tanks, dispensing equipment, or fuel handling errors occurring after delivery.
Products and Services We Do Not Offer
For regulatory and operational clarity, Exigo Fuels does not offer ocean-going ship bunkering (barge operations), home-heating-oil delivery to residential customers, or retail gasoline station services. Tax-exempt off-road dyed diesel is supplied strictly in accordance with IRS §4082 and Florida Department of Revenue rules; customers are responsible for end-use compliance. DEF (diesel exhaust fluid) is not offered.
Equipment Rental Terms
Equipment rentals (storage tanks, pumps, dispensers, monitoring systems) are subject to a separate written rental agreement specifying equipment, rental duration, deposit, return condition, and responsibility for damage, loss, or vandalism. The renter is responsible for site safety, fire code compliance (NFPA 30 and NFPA 30A), appropriate signage, and EPA SPCC plan coverage during the rental period. Site Access, Safety, and Compliance
Customers are responsible for providing safe, legal, and accessible delivery locations. Delivery sites must comply with applicable fire codes, OSHA requirements (29 CFR 1910.106), and local permitting rules. Exigo Fuels drivers reserve the right to refuse delivery if the site is unsafe (unstable ground, electrical hazards, blocked egress, unlabeled tanks, active welding, insufficient grounding, or other hazards). Any cancellation for safety reasons does not constitute a breach of contract, and delivery will be rescheduled at the customer's convenience once the site is corrected.
Driver Conduct and Identification
All Exigo Fuels drivers carry DOT medical cards and CDL credentials with Hazardous Materials endorsement where required, and are equipped with TWIC cards when serving port facilities. Drivers carry company identification and arrive in Exigo Fuels-marked vehicles. Customers may verify driver credentials before granting site access; we encourage it.
Limitation of Liability
To the maximum extent permitted by law, Exigo Fuels shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost business opportunity, equipment downtime, generator damage, or business interruption — arising from or related to the use of our services or website, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from or related to a specific delivery, equipment rental, or service engagement shall not exceed the amount paid by the customer for that specific service in question during the preceding ninety days.
Indemnification
You agree to indemnify, defend, and hold harmless Exigo Fuels, its officers, directors, employees, drivers, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our services, (b) your violation of these Terms, (c) your violation of any law or third-party right, (d) site conditions or equipment issues not caused by Exigo Fuels, or (e) any claim arising from improper use of delivered fuel or rented equipment after it is in your possession or control.
Insurance
Exigo Fuels carries General Liability, Auto Liability (including pollution coverage), Workers Compensation, and Cargo insurance in amounts meeting or exceeding industry standards. Certificates of Insurance are available on written request and will be issued to named additional insureds where contractually required. Customers requiring specific endorsements must request them at least ten business days before the first scheduled delivery.
Data Collection and Privacy
Our website collects anonymized analytics data and form submissions for the purpose of responding to inquiries and improving service. Personal information submitted through contact forms is used only for responding to service requests and is not sold or shared with third parties except as required by law or as necessary to fulfill your service request (for example, transmitting credit-card data to payment processors). Force Majeure
Exigo Fuels shall not be liable for delays, failures, or inability to perform caused by events beyond our reasonable control, including but not limited to: hurricanes, tropical storms, floods, fires, earthquakes; acts of war, terrorism, civil unrest, or sabotage; fuel supply disruptions or refinery outages; port closures; government orders, embargoes, or emergency declarations; labor disputes affecting fuel supply or transportation; pandemic-related restrictions; cyber incidents affecting dispatch or delivery systems; or other acts of God or regulatory action. During declared emergencies, Exigo Fuels will prioritize existing contracted customers in accordance with our emergency dispatch policy.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and both parties consent to the personal jurisdiction and venue of those courts. You and Exigo Fuels each waive any right to a jury trial on any matter arising under these Terms.
Modifications to These Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. For customers with written supply or rental agreements, those agreements control over any conflicting provision in these Terms. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.
Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any written supply agreement, rental agreement, or credit application in effect, constitute the entire agreement between you and Exigo Fuels regarding our services and supersede all prior oral or written understandings.
